Description

Although the concept of workers’ compensation is simple, coverage for an insured “employee,” the application of who counts as an employee isn’t as simple.

Why? Because there is more than one type of “employee,” in fact, there are four types:

  • Direct Employees
  • De Facto Employees
  • De Jure Employees
  • “Special” Employees

Beyond the four types of “employees,” the employer’s legal status also dictates who is counted as an employee. This section puts all these pieces together to help us decipher who counts.

To be compensable, the injury must be “occupational.” To be occupational, three tests must be satisfied. The injury must…

  • “Arise out of…”
  • Be “in the course of…” and
  • “Within the Scope of employment”

Each of these is a separate threshold requirement that must be met. In this section, these three requirements are discussed.

In this section we detail the ABCs of the premium audit and review what remuneration is included and what remuneration is excluded from the audit.
